XXI article of the Treaty in question is becoming practically a nullity as regards its observance by the Government of Hongkong, I deem it my duty to obtain from you authoritative instructions as to (1) whether I ought or ought not to be guided in this case by the opinion of the Acting Attorney-General, and (2) if probable, his opinion of the existing law be correct, whether that law should not be amended, so as to permit of such an offender being given up in the future.

The judgment of the Judicial Committee of the Privy Council in the case of the Attorney-General of Hongkong v. Kwok Asing, (to which Mr Ackroyd refers), would indeed seem to limit the meaning of the words "crimes or offences against
